7. User Content

The Service may allow you to create, post, share, or store content ("User Content"). You retain ownership rights in your User Content, but grant Xelptra a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the Service. You represent that you have all necessary rights to your User Content and that it does not violate any third-party rights.

8. Disclaimer of Warranties

IN NO EVENT SHALL XELPTRA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Canada for the resolution of any disputes.
